Terms of use
Last updated:
These terms govern the use of the Using English app and the website usingenglish.app, provided byQueens English Academy, S.L.U. (“we”). Our full details are in the legal notice. By creating an account you accept these terms; please read them together with the privacy policy. If you do not agree, do not use the app. The Spanish version prevails in case of discrepancy.
1. The service
Using English is an app to practise the Use of English paper of the Cambridge B2 First (FCE) exam: exercises for all four parts, marking, statistics, study material and challenges between friends. It is an independent practice tool:it is not affiliated with or endorsed by Cambridge University Press & Assessment and does not guarantee any result in the official exam.
2. Your account
- You need an account with a valid email address, a username and a password.
- You must be at least 14. If you are younger, you need the consent of your parent or legal guardian, who will be responsible for your use of the app.
- Your account is personal: do not share it. For security it can only be open on one phone at a time; signing in on another phone signs you out of the previous one.
- You are responsible for keeping your password secret. If you think someone has accessed your account, tell us.
- You can delete your account at any time from Profile → Delete account (see how).
3. Plans and prices
- Free: includes part of the content at no cost and with no time limit.
- PLUS and PRO are one-off payments, not subscriptions: you pay once, there are no recurring charges and you keep access to what your plan includes for as long as we provide the service. If you have PLUS you can upgrade to PRO by paying only the difference shown in the app.
- What each plan includes and its final price, taxes included, are shown in the app before you buy.
- Purchases are sold and charged by Apple (App Store) or Google (Google Play) using your store account, and are also governed by their terms. We never receive your card details.
- If you change phone, recover your plan with “Restore purchase” using the same store account. Purchases made on iPhone cannot be moved to Android or vice versa.
4. Withdrawal, refunds and guarantee
- As the store is the seller, the right of withdrawal and refunds are handled by the store under its terms. Apple and Google offer a period in the European Union to cancel or request a refund of purchases: you can request it atreportaproblem.apple.com or from yourGoogle Play order history.
- Paid content is digital and unlocks as soon as the purchase is confirmed. Under EU consumer law, the right of withdrawal may not apply once access has begun if you expressly requested it and acknowledged that you lose that right, as the store tells you when you buy.
- You also have the legal guarantee of conformity for digital content: if what you bought does not work or does not match what was advertised, write to us and we will fix it and, if that is not possible, you can ask for a refund or a proportionate price reduction. As this is ongoing access, the guarantee covers the whole time we provide the service.
5. Friends, challenges and community rules
With the friends feature other users can see your name, username, photo and the results of your challenges with them. So you agree not to use names, usernames or photos that are offensive, violent, sexual, discriminatory, impersonate someone else or infringe third-party rights, and not to harass or bother other users with requests or challenges.
You can decline requests and remove friends at any time. If you see a name, photo or behaviour that breaks these rules or that you believe is illegal, report it by writing toinfo@usingenglish.app with the username, what is happening and why you think it is inappropriate or illegal. We will review every report diligently and, where appropriate, remove the content or suspend the account. We will tell you what we decide and, if the measure affects your account, we will explain why and you will be able to respond.
6. Acceptable use
You also agree not to:
- copy, bulk-extract, publish or resell the exercises, explanations, videos or images in the app;
- try to access other users' data or unauthorised parts of the service, tamper with the app or bypass its limits;
- use automated programs to use the app, or share your account with other people;
- use the app for illegal purposes or against these terms.
7. Suspension and closure of accounts
If you seriously or repeatedly breach these terms, we may suspend or close your account. Unless it is urgent to protect other users or the service, we will warn you first and explain why, so you can respond. Any measure will be proportionate.
8. Intellectual property
The exercises, texts, explanations, videos, designs, the Using English name and the Pimbleton character belong to us or are used under licence. We grant you a personal, non-exclusive, non-transferable licence to use the app for study. “Cambridge”, “B2 First” and “FCE” are trademarks of their respective owners.
Your username and photo remain yours. You only allow us to store and display them in the app while you have the account.
9. Availability and changes to the app
We work to keep the app running, but there may be interruptions for maintenance, updates or reasons beyond our control. We may improve the app and add, change or remove content and features for valid reasons (for example, to fix bugs, adapt to changes in the exam or the law, or improve security), at no cost to you. If a change materially harms what a plan you bought includes, we will notify you in advance and you may terminate the contract and get the refund the law provides.
If we ever decide to stop offering the app, we will give you at least 60 days' notice.
10. Liability
The app is offered as practice material. We are not responsible for the score you get in the official exam or for use of the app contrary to these terms. Nothing in these terms limits our liability for wilful misconduct or gross negligence, for personal injury or, in general, the rights consumer law gives you.
11. If you download the app from the App Store
If you use the app on an Apple device, the following also applies:
- These terms are an agreement between you and us, not with Apple. We, not Apple, are responsible for the app and its content, its maintenance and support, and for handling any claim about it (including product liability, legal compliance or third-party intellectual property claims).
- If the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price; to the extent permitted by law, Apple has no other warranty obligation regarding the app.
- You will use the app in line with the App Store usage rules. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
12. Changes to these terms
If we change these terms we will publish the new version here with its date. If the change is significant, we will let you know in the app before it applies; if you do not agree, you can stop using the app and delete your account.
13. Governing law and complaints
These terms are governed by Spanish law. If you are a consumer you may go to the courts where you live and you keep the protection given by the laws of your country of residence. If you have a complaint, write to us first: we will reply as soon as possible and within one month at most. We are not part of any consumer arbitration scheme, but you can also contact the consumer services of your region or country.
14. Contact
